By accessing or using MoldaSpace ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

MoldaSpace is an AI-powered visualization platform for architects and interior designers. The Service allows users to:

• Upload images (sketches, room photos, floor plans)
• Generate AI-powered visualizations and transformations
• Organize projects and manage design variations
• Export and download generated images

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You must be at least 18 years old to create an account and use the Service.

4. Credits and Payments

4.1 Credit System

Image generations require credits. Credits are consumed when you generate images. Credit costs may vary by feature and are displayed before generation.

4.2 Purchases

Credits are purchased through our payment processor, Stripe. All purchases are:

• Subject to a 7-day money-back guarantee from purchase date
• Non-transferable between accounts
• Valid indefinitely while your account remains active

4.3 Refunds

Refund requests within 7 days of purchase will be honored. After 7 days, refunds are at our discretion. To request a refund, contact us at support@moldaspace.com.

5. Acceptable Use

You agree NOT to use the Service to:

• Upload or generate illegal, harmful, or offensive content
• Generate content depicting real people without consent
• Create deepfakes, misinformation, or deceptive media
• Infringe on intellectual property rights of others
• Distribute malware or engage in hacking activities
• Attempt to bypass usage limits or security measures
• Use automated systems to access the Service without permission
• Resell or redistribute the Service without authorization
• Harass, abuse, or harm other users

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

6.1 Your Content

You retain ownership of images you upload. By uploading content, you grant us a limited license to process, store, and display the content as necessary to provide the Service.

6.2 Generated Content

You own the images generated through the Service, subject to:

• These Terms of Service
• Any applicable third-party licenses
• The requirement that you have rights to any input images

You may use generated images for personal and commercial purposes. We do not claim ownership of your generated content.

6.3 Our Content

The Service, including its design, features, and documentation, is owned by MoldaSpace and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content.

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate images. You acknowledge that:

• AI outputs may not always be accurate or suitable for your needs
• Generated images are for visualization purposes and may not reflect real-world outcomes
• You are responsible for reviewing and verifying generated content before use
• We do not guarantee that generated content will meet specific requirements
• AI models may produce unexpected or inconsistent results

8. Service Availability

We strive to provide reliable service but do not guarantee:

• Uninterrupted or error-free operation
• Availability at all times
• Compatibility with all devices or browsers
• Preservation of stored content indefinitely

We may modify, suspend, or discontinue features with or without notice. We recommend keeping local copies of important content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind
• We disclaim all implied warranties, including merchantability and fitness for a particular purpose
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the past 12 months

10. Indemnification

You agree to indemnify and hold harmless MoldaSpace, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

You may terminate your account at any time through account settings or by contacting us.

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Fail to pay for purchased services
• Abuse the Service or other users

Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period.

12. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved in the courts of competent jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
