2. Agreement to Terms

By accessing or using MoldaSpace ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a binding agreement between you and AFPrado LTDA. By using the Service, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and any applicable laws, including but not limited to the Brazilian Consumer Defense Code (CDC - Law 8.078/1990) and the Brazilian General Data Protection Law (LGPD - Law 13.709/2018).

3. Service Description

MoldaSpace is an AI-powered interior design visualization platform. The Service allows users to:

The Service is provided via web application accessible at www.moldaspace.com.

Upload room photos and interior images
Generate AI-redesigned versions of their spaces using artificial intelligence
Manage design projects through a canvas-based editor
Store and organize design images in the cloud
Export and download generated images

4. Account Registration

To access the full features of the Service, you must create an account. By registering, you agree to the following:

You must be at least 18 years old to create an account
Authentication is handled via Clerk (email or social login providers)
You are responsible for maintaining the security of your account credentials
You must not share your account with third parties
Only one account per person is permitted
You agree to provide accurate and complete registration information
You must notify us immediately of any unauthorized access to your account
You accept responsibility for all activities conducted under your account

5. Credit System and Pricing

The Service operates on a credit-based system for AI image generation.

5.1 Free Trial

New users receive 5 (five) free credits upon first sign-up. These credits allow you to try the Service before making any purchase.

5.2 Credit Usage

Each AI image generation consumes 1 (one) credit. The credit is deducted at the time the generation is initiated.

5.3 Credit Packs

Credits can be purchased in the following packs:

Prices are displayed in US dollars (USD) and may be subject to applicable taxes.

Starter Pack: 10 credits for US$ 6.00
Standard Pack: 40 credits for US$ 19.00

5.4 First Purchase Bonus

On your first credit purchase, you receive 5 (five) additional bonus credits at no extra cost.

5.5 Credit Properties

Credits do not expire while your account remains active
Credits are non-transferable between accounts
Credits have no monetary value and cannot be exchanged for cash
Prices may be updated at any time; purchased credits are not affected by price changes

6. Right of Withdrawal

In accordance with Article 49 of the Brazilian Consumer Defense Code (CDC - Law 8.078/1990), you have the right to withdraw from any purchase made through the Service within 7 (seven) calendar days from the date of purchase, without the need to justify your decision.

6.1 How to Exercise Your Right

To request a withdrawal and refund, send an email to support@moldaspace.com with the following information:

Your full name and email associated with the account
Date of purchase
Order or transaction reference
Reason for withdrawal (optional)

6.2 Refund Process

Refunds will be processed within 10 (ten) business days of the request
Refunds will be credited to the original payment method used for the purchase
If credits from the purchase have already been consumed, only the value corresponding to unused credits will be refunded
Free trial credits and bonus credits are not eligible for refund

6.3 Important Notice

This right of withdrawal cannot be waived by contract and applies to all purchases made remotely (online). This is a legally guaranteed right under Brazilian law.

7. Payment Terms

All payments are processed securely by Stripe, a PCI-DSS compliant payment processor
MoldaSpace does not store your credit card numbers or banking details
Prices are displayed in US dollars (USD) as shown at the time of purchase
MoldaSpace offers both one-time credit packs and an optional monthly subscription plan
A receipt is sent via email after each successful purchase
By making a purchase, you authorize Stripe to charge the designated payment method

8. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you must NOT:

Violation of these terms may result in immediate suspension or termination of your account.

Upload, generate, or distribute illegal, harmful, or offensive content
Upload images that infringe on third-party copyrights or intellectual property rights
Generate or attempt to generate NSFW, adult, or sexually explicit content
Use automated systems, bots, or scripts to access the Service without authorization
Resell, sublicense, or redistribute the Service or its outputs without authorization
Attempt to reverse-engineer, decompile, or extract the underlying AI models or technology
Interfere with or disrupt the Service or servers
Impersonate any person or entity
Use the Service for any purpose that violates applicable laws or regulations

9. Intellectual Property

9.1 Your Uploaded Content

You retain all rights to images you upload to the Service. By uploading content, you grant MoldaSpace a limited, non-exclusive license to process, store, and display the content solely as necessary to provide the Service.

9.2 AI-Generated Content

Images generated through the Service are provided to you with a usage license for both personal and commercial purposes, subject to:

9.3 Platform Rights

The Service, including its design, user interface, features, documentation, brand, logos, and underlying technology, is owned by AFPrado LTDA and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our proprietary content without express written permission.

10. Limitation of Liability

To the extent permitted by law, including the Brazilian Consumer Defense Code (CDC):

Nothing in these Terms excludes or limits consumer rights that cannot be excluded or limited under the CDC or other applicable consumer protection legislation.

The AI image generation service is provided on an 'as is' basis regarding the quality and accuracy of generated images
MoldaSpace shall not be liable for indirect, incidental, special, or consequential damages, except where mandatory consumer rights under the CDC apply
MoldaSpace's total aggregate liability to you shall not exceed the total amount paid by you to MoldaSpace in the 12 (twelve) months preceding the event giving rise to the claim
MoldaSpace is not responsible for outages or interruptions of third-party services (including Clerk, Stripe, Cloudflare, or AI providers) that are beyond our reasonable control

11. Service Availability

MoldaSpace uses best efforts to maintain the availability and quality of the Service
Scheduled maintenance may temporarily affect access to the Service; we will provide advance notice when possible
No uptime guarantee or service level agreement (SLA) is provided
MoldaSpace reserves the right to modify, update, or discontinue features of the Service with reasonable prior notice
We recommend that users maintain local copies of important content

12. Account Termination

12.1 Termination by You

You may delete your account at any time through your account settings or by contacting support@moldaspace.com. Upon voluntary termination, your data will be handled in accordance with our Privacy Policy.

12.2 Termination by MoldaSpace

MoldaSpace may suspend or terminate your account if you:

Upon termination for cause, unused credits are forfeited. We will provide notice before termination when feasible, except in cases of severe violations.

Violate these Terms of Service
Engage in fraudulent, abusive, or illegal activity
Abuse the Service or other users

12.3 Effects of Termination

Upon termination of your account:

Your right to access and use the Service ceases immediately
Your data will be deleted in accordance with our Privacy Policy and applicable data protection laws
Any unused credits may be forfeited if the account was terminated for cause

MoldaSpace is committed to protecting your personal data in accordance with the Brazilian General Data Protection Law (LGPD - Law 13.709/2018).

14. Dispute Resolution

14.1 Amicable Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms, the parties shall first attempt to resolve the matter amicably within 30 (thirty) days by contacting legal@moldaspace.com.

14.2 Consumer Protection Platform

As a consumer, you may also use the Brazilian government's consumer protection platform at consumidor.gov.br to register complaints and seek resolution.

14.3 Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil.

The jurisdiction for resolving disputes is the Comarca de Ponta Grossa, Parana, Brazil, without prejudice to the consumer's right to choose the jurisdiction of their own domicile, as provided by Article 101, I of the CDC.

15. Modifications to These Terms

MoldaSpace reserves the right to modify these Terms at any time.

Users will be notified of material changes via email at least 30 (thirty) days before the changes take effect
Continued use of the Service after the notice period constitutes acceptance of the updated Terms
If you do not agree with the modified Terms, you may terminate your account before the changes take effect

16. General Provisions

16.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16.2 No Waiver

The failure of MoldaSpace to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.3 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and MoldaSpace regarding the use of the Service, superseding any prior agreements.

16.4 Assignment

MoldaSpace may assign or transfer these Terms, in whole or in part, without restriction. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
